Michael Wertheim helps employers navigate complex workplace disputes with a practical, business-minded approach. He represents employers in every aspect of employment law, including wage and hour class actions, PAGA matters, discrimination and harassment claims, wrongful termination disputes, and traditional labor law.
Michael’s practice centers on defending class, collective or representative actions involving allegations of misclassification, overtime violations, meal and rest break compliance, off-the-clock work, wage statement issues, reimbursement claims, and all manner of California Labor Code compliance. As a class action litigator, Michael understands high-value transactions. The scale of these cases typically involves thousands of individuals, where potential exposure can eclipse seven or eight figures.
In addition to class litigation, Michael defends whistleblower, discrimination, harassment, retaliation and wrongful termination cases, and serves as a day-to-day advisor to employers navigating California’s evolving employment laws. He works closely with management teams and in-house counsel on workplace policies, employee discipline, investigations, accommodations, reductions in force, separation issues, and preventative compliance strategies designed to reduce litigation exposure before disputes arise.

- Successfully opposed class certification of multiple California Labor Code claims on behalf of an international laboratory company in a class action alleging violations related to unpaid overtime, meal and rest break violation and other derivative claims.
- Obtained summary judgment and dismissal of multi-plaintiff litigation involving whistleblower claims asserting over $10,000,000 in damages under the False Claims Act and Fair Employment and Housing Act.
- Obtained dismissal of a former executive’s claims in a breach of contract claim seeking over $63,000,000 in damages.
- Obtained dismissal in arbitration on behalf of a debt relief company on a disability discrimination claim seeking over $1,000,000 in damages.
- Successfully first chaired and defeated wrongful termination in a single-plaintiff arbitration asserting disability discrimination claims against an international shipping company.
- Represented a payment processing company in a multimillion-dollar dispute over breach of contract and other executive compensation issues.
- Represented several media companies in a high-stakes single plaintiff discrimination and retaliation action, managing all aspects of pre-trial litigation and obtained a settlement at the eve of trial based on powerful evidence gained from depositions and other third-party discovery.
- Compelled multiple class and PAGA claims to arbitration where exposure would otherwise have been in the millions, resulting in settlements or early adjudications.
