Phillip V. Marano has spent more than a decade advising clients on matters at the intersection of intellectual property law and the internet. He works with global leaders in the apparel, entertainment, financial services, hospitality, insurance, luxury goods, media, nonprofit, pharmaceutical, retail, spirits, sports, technology, and telecommunications industries.
Phil counsels clients on virtually all aspects of global trademark and copyright creation, clearance, prosecution, management, and enforcement. He provides regulatory and pre-litigation advice on trademark, copyright, social media, and right of publicity matters, and litigates cancellation and opposition proceedings before the Trademark Trial and Appeal Board. In addition to settlement, consent, and coexistence agreements, Phil negotiates a wide array of intellectual property licenses, assignments, and marketing agreements.
Phil regularly partners with internet intermediaries to identify and limit liability, determine acceptable legal and compliance risk, and align legal strategies with business goals. He advises on intermediary liability for copyright and trademark infringement, and negotiates a broad array of transactions with an emphasis on intellectual property and technology, including master service agreements, nondisclosure agreements, talent agreements, data and cash escrow agreements, internet service provider accreditation agreements, website terms of service, privacy policies, copyright and trademark takedown policies, sponsorship agreements, film collaboration agreements, auction bidder agreements, advertising agency agreements, and web hosting agreements.
Drawing on deep knowledge of the domain name industry and large network of internet intermediary contacts, Phil develops and oversees online anti-counterfeiting and anti-piracy programs, as well as manages global domain name portfolios, disables illegal online content, de-anonymizes criminal actors, and recovers domain names from cybersquatters worldwide. He has developed and executed strategies for top and second-level domain name acquisition, management and dispute resolution, including over two-hundred launches of new generic and Brand Top-Level Domains. He also collaborates with internet ecosystem stakeholders to advance policy positions, and shape regulations and national legislation, concerning the Internet Corporation for Assigned Names and Numbers (ICANN).
Prior to entering private practice, Phil conducted ex parte examinations of trademark applications filed with the U.S. Patent and Trademark Office.
