Nina D.   • Defended Sony Pictures Entertainment in a federal jury trial involving a claimed $50 million lawsuit alleging interference with a promoter’s contracts with personalities from client's hit television show and involving trademark counterclaims. After the close of plaintiffs’ case, the federal judge dismissed the plaintiffs’ case with prejudice.   • Represents Ares Management, a publicly traded, leading global alternative asset manager with approximately $137 billion of assets under management and approximately 1005 employees. Manages and enforces worldwide trademark and domain name portfolio, advice and counseling regarding copyright and privacy matters.
  • Represented the Estate of Michael Jackson in various lawsuits against the Estate, including obtaining an injunction in a trademark case that was affirmed by the Ninth Circuit. Branca v. Heal the World Found., 568 F. App'x 521 (9th Cir. 2014).
  • Represents user-generated content website in copyright and trademark disputes.
  • Obtained a temporary restraining order and later permanent injunction against counterfeiters of brand-name jeans.
  • Represented defendant in Telephone Consumer Protection Act putative class action brought over confirmatory text messages. Ibey v. Taco Bell Corp., 2012 WL 2401972 (S.D. Cal. 2012).
  • Represented MySpace, Inc. in MySpace, Inc. v. Media Breakaway, LLC, which resulted in a more than $6 million judgment in favor of MySpace for claims under the CAN-SPAM act and related state law claims.
  • Represented MySpace, Inc. in MySpace, Inc. v. Wallace, 498 F. Supp. 2d 1293 (C.D. Cal. 2007), enjoining a defendant under the CAN-SPAM Act.
  • Represented MySpace, Inc. in MySpace, Inc. v. TheGlobe.com, Inc., 2007 WL 1686966 (C.D. Cal. 2007), granting summary judgment under the CAN-SPAM Act, California's anti-spamming statute and for breach of MySpace's Terms of Use, including its $50 per email liquidated damages clause. The case settled on confidential terms in 2007.
