Mary Beth Myles advises companies on trademarks and other intellectual property matters, with a practice that includes clearance, prosecution, enforcement, portfolio management, and disputes before the Trademark Trial and Appeal Board (TTAB) and in federal court. She works with global companies and coordinates with foreign counsel on international portfolios. Her background also includes patent cases in the pharmaceutical industry and service within a government agency, where she handled trademark appeals and inter partes proceedings.
Drawing on years at the TTAB, Mary Beth guides clients on the full life cycle of Board practice—ex parte appeals from refusals to register, oppositions, cancellations, and concurrent use proceedings. She evaluates pleading strategy, motion practice, and evidentiary issues with an eye toward what the Board expects, informed by experience adjudicating and authoring decisions, including precedential rulings. She also advises on pretrial conference preparation, hearing practice, and the crafting of amendments and settlement agreements with the goal of meeting procedural requirements, having reviewed and approved amendments and concurrent use settlement agreements while at the Board. That perspective extends to case management, scheduling, and communication with unrepresented parties, which informs how she helps clients plan and present their cases.
Beyond TTAB disputes, Mary Beth counsels on trademark clearance and prosecution, international portfolio management, and risk assessment. She manages watch notices and search reports, prepares and responds to cease-and-desist letters, and handles domain name and online enforcement matters, including website and social media takedown requests. Her work includes drafting and negotiating intellectual property agreements such as licenses, assignments, releases, and settlements, and reviewing marketing and promotional materials for brand and copyright considerations. She coordinates closely with foreign counsel on international filings, conflicts, and registrations, and prepares client presentations on intellectual property rights and risks. Mary Beth also handles intellectual property litigation in federal court, including trademark, copyright and patent matters.
Professional involvement has been a consistent part of Mary Beth’s career. She has contributed to revisions of the TTAB’s Manual of Procedure and co-authored practical guidance on advanced TTAB practice. She has served as a volunteer judge for the International Trademark Association’s Saul Lefkowitz Moot Court Competition and participated in Board engagement and outreach, including presentations on TTAB practice. She also served on the Pretrial Conference Pilot Program committee, helping develop and launch the initiative.
