Josh helps businesses protect their intellectual property (including trademarks, copyrights, patents, trade secrets) and navigate disputes with other companies related to such assets.

Board Certified in Intellectual Property Law by the Florida Bar, Josh litigates intellectual property disputes before various federal courts and administrative bodies. He has handled patent infringement cases in the Middle District of Florida, the Eastern District of Texas, and other districts. He has filed petitions for Inter Partes Review before the Patent Trial and Appeal Board. He has represented clients in trademark cases before the Trademark Trial and Appeal Board, the Middle District of Florida, the Southern District of Florida, the Central District of California, and other districts. He has also advised clients on legal issues related to artificial intelligence, blockchain, cloud computing, data retention, trade secrets, non-compete agreements, publicity rights, software development, DMCA takedown notices, and other intellectual property and technology issues. A patent attorney, Josh also drafts and prosecutes patent applications in the fields of computer software, networking, and mobile technologies and prosecutes trademark applications on behalf of his clients. Josh counsels clients and other attorneys on issues related to the preservation and discovery of electronically stored information. Josh has particular interest in Legal Ethics and has given numerous presentations on ethical issues posed by emerging technologies including cloud computing, Blockchain, and Gen AI. Josh has significant experience working with and opposing expert witnesses at deposition and trial.

Before attending law school, Josh was a software developer with BBN Technologies in Cambridge, Massachusetts, and a technology consultant to the Massachusetts Bay Transportation Authority.

  • Currently defending multiple international copyright infringement claims in the Southern District of Florida related to telenovelas broadcast through multiple television channels.
  • Defended AAA arbitration proceeding in Wilmington, Delaware related to copyright infringement, trade secret misappropriation, and breach of software license agreement.
  • O-Line Academy v. NBC Universal (C.D. Ca. 2016; Hatter, J.): Defended NBC Universal and Endemol Shine North America in trademark infringement action. Obtained transfer to CA, dismissal with prejudice of trademark dilution count, and dismissal of related claim.
  • Tile World Corp. v. Miavana, 2016 WL 370540 (M.D. Fla. 2016; Antoon, J.): Defended grocery distributor in trademark and trade dress infringement action brought by sugar wholesaler. Defeated Motion for Preliminary Injunction.
  • LaTele v. Telemundo (S.D. Fla. 2015; Lenard, J.): Defended Telemundo in copyright infringement action related to telenovela. Obtained stay of litigation, and fee award against Plaintiff totaling over $500,000 for discovery misconduct. See 2014 WL 5816585 (Nov. 10, 2014), awarding fees, aff’d on appeal.
  • D’Amato v. Orlando Solar Bears (M.D. Fla. 2015; Byron, J.): Obtained complete dismissal and $220,000 attorneys’ fees award against Plaintiff in trademark and copyright infringement action based on pro sports team’s name and logo.   • Defended Fortune 100 company against trademark infringement claims related to consumer electronics product.
  • Prosecuted trademark infringement actions against Florida companies for national transportation services franchise.°
  • Defended federal trademark opposition proceeding before the Trademark Trial and Appeal Board on behalf of national running event organizer. Obtained settlement of all claims and federal registration of the disputed marks.°
  • Defended national staffing company in trademark infringement suit and opposition proceeding. Obtained settlement of all claims on confidential terms.°
  • TCS Int’l v. ParkHelp (S.D. Tex. 2015) Obtained voluntary dismissal of patent infringement action on behalf of U.S. subsidiary of Spanish parking automation company.
  • Weiss v. PlayCycle (C.D. Ca. 2016) and Stoner v. Drink Blocks (M.D. Fla. 2016; Byron, J.): Represented innovator in beverage container industry in multi-action litigation including claims of misappropriation of trade secrets and correction of inventorship.
  • Represented smartphone manufacturer in patent infringement litigation including petitioning Board of Patent Appeals and Interferences to invalidate asserted claims related to MMS.
  • Defended patent infringement and breach of contract action on behalf of related to power motion furniture.
  • Defended innovative company in the field of social media advertising against patent infringement claim.
  • Defended app manufacturer and provider of online consumer information platform in the field of transportation against patent infringement claim.
  • Brought patent infringement suit on behalf of international telecommunications provider related to voiceover IP patents.°
