Greenberg Traurig vertritt CoviMedical bei Rückforderung der Kassenärztlichen Vereinigung Hessen

MUNICH – March 12, 2026 –  Global law firm Greenberg Traurig advised CoviMedical GmbH (part of the CKM Group) in summary proceedings before the Hessian Administrative Court (VGH, decision of March 6, 2026, Ref. 8 B 1146/25) against the order for immediate enforcement of a recovery notice issued by the Association of Statutory Health Insurance Physicians in Hesse (KVH).

CoviMedical is one of the largest operators of testing centers in Germany/Europe during the coronavirus pandemic. The KVH now demanded €56.4 million in connection with alleged irregularities in the submitted service documentation and ordered immediate enforcement. The VGH has now fully restored the suspensive effect of CoviMedical GmbH's appeal in the second instance.

The VGH's decision is a landmark ruling that will contribute to greater clarity in the handling of the coronavirus pandemic. As legal representative in the second instance, Greenberg Traurig achieved success in that the 8th Senate agreed with the arguments presented in all key points in its reasoning. The court clarified that a blanket demand for repayment of the entire remuneration is inadmissible if only individual irregularities are found. The irregularities discussed undisputedly affected only a small percentage of the total of over two million tests billed; the court saw no evidence of systematic misconduct. The costs of the proceedings will be borne by the KVH.
