Zach Tobolowsky represents businesses and individuals across a wide range of industries in complex business disputes. He counsels both plaintiffs and defendants through all stages of litigation in federal and state courts. Zach has handled a broad array of commercial and intellectual property disputes, including lawsuits involving breach of contract, fraud, trade secret misappropriation, tortious interference, breach of fiduciary duty, unfair competition, trademark and trade dress infringement, patent infringement, copyright disputes, antitrust claims, DTPA violations, UCC violations, the Computer Fraud and Abuse Act (CFAA), insurance coverage, employment disputes, and various other business torts.

- Served as lead counsel for a private equity real estate company in litigation against a real estate investment and operations company for fraud and breach of contract relating to a joint venture involving a large portfolio of multi-family properties. Obtained an award of over $9 million (including attorney’s fees) on summary judgment.
- Represented one of the leading private poker clubs in Texas in a lawsuit filed by a Dallas city official seeking to revoke the club’s certificate of occupancy and shut down its operations. Secured a final judgment rendered on appeal in favor of client, resulting in client’s right to continue operating.
- Represented subsidiaries of the largest U.S. ambulatory surgery platform and owner/operator of surgery centers in obtaining a complete dismissal of all claims brought by a limited partner alleging breach of partnership agreement, fraud, breach of fiduciary duty, and other claims.
- Represented a national bank in defending a lawsuit brought by a commercial real estate company asserting claims for conversion, negligence, and violations of federal banking regulations. Obtained a complete dismissal of all claims.
- Represented the largest U.S. airline in a lawsuit against an online travel agency for trademark infringement, copyright infringement, unfair competition, breach of contract, and tortious interference, resulting in a $9.4 million jury verdict in favor of client.
- Represented a Texas-based bank in defending an action brought by a bankruptcy debtor’s trustee alleging claims of aiding and abetting fraudulent transfers, civil conspiracy, money had and received, and violations of federal banking regulations in connection with an alleged Ponzi scheme. Obtained a complete dismissal of all claims.
- Represented the largest U.S. airline in a lawsuit brought by one of its in-flight technology vendors alleging breach of licensing agreement.
- Represented a private equity firm and family office in defending against a lawsuit seeking commissions/fees from client and investors’ consortium group in connection with a $1.84 billion acquisition of a leading natural gas company.
- Served as lead counsel for a healthcare consulting company in lawsuit against a hospital for breach of a consulting services agreement, and secured a settlement for client.
- Represented a men’s clothing company in a dispute with a marketing affiliate involving alleged unpaid sales commissions.
- Served as lead counsel for a healthcare staffing agency and its affiliate in a lawsuit against the owner of a medical facility for breach of contract, unjust enrichment, and quantum meruit. Secured a full recovery of all amounts sought by client.
- Served as lead counsel for a healthcare staffing agency in a dispute against a managed service provider involving claims for breach of contract. Secured a full recovery of all amounts sought by client.
- Served as lead counsel for a managed service provider in a lawsuit against a healthcare staffing agency and its affiliates for breach of contract and tortious interference. Secured a full recovery of all amounts sought by client.
- Served as lead counsel for a real estate investment and development company in a lawsuit against a joint venture partner and its affiliates for breach of a joint venture agreement and guaranty.
- Served as lead counsel for an Israeli publicly traded real estate company in arbitration against a real estate investment firm for breach of a joint venture agreement and buy-out agreement.
- Represented one of the largest U.S. airlines in lawsuits against online travel agencies involving claims of trademark infringement, Computer Fraud and Abuse Act (CFAA) violations, and breach of contract, and obtained permanent injunction against online travel agencies.°
- Represented international pharmaceutical company and its domestic and foreign affiliates in a lawsuit alleging patent infringement, trade secret misappropriation, trade dress infringement, breach of contract, unfair competition, and other business torts relating to injection training technology. Obtained dismissal of various claims and defendants, and invalidated various asserted patent claims.°
- Represented the credit/financing arm of the world’s largest automotive manufacturer in a lawsuit involving claims of UCC violations, fraud, breach of contract, and DTPA violations. Obtained complete dismissal of all claims against the client.°
- Represented specialty finance firm in a collective action lawsuit involving claims of fraud, breach of contract, conspiracy/aiding and abetting, and FLSA violations. Obtained complete judgment on all claims in favor of the client.°
- Served as second-chair in a jury trial representing one of the largest U.S. memorabilia and jewelry manufacturers in a lawsuit alleging breach of fiduciary duty, conversion, and civil theft. Obtained a complete jury verdict on all claims in favor of the client, resulting in a $9.5 million damages award.°
- Represented an international video game technology company in a patent infringement lawsuit against a video game equipment manufacturer involving alleged infringement of patents relating to gaming controller technology.°
- Served as lead counsel for national insurance company in a lawsuit against a commercial fire protection systems provider.
- Represented Chinese technology company in proceedings before the International Trade Commission and Federal Circuit Court of Appeals involving claims of patent infringement relating to electric hoverboards. Obtained ITC Final Determination of non-infringement in favor of the client and decision on appeal precluding patent owner from reasserting patent claims.°
- Represented institutional oil and gas brokerage firm in defending multiple FINRA arbitrations.
- Served as co-trial counsel for grocery store chain in a lawsuit against former employee for breach of contract and temporary restraining order, and obtained a trial verdict and award of attorneys’ fees in favor of the client.°
- Represented commercial lender in a receivership action against global relocation and moving/storage company, and obtained an order appointing a receiver to take possession of all assets belonging to the debtor.°
- Represented foreign cybersecurity firm in a lawsuit alleging breach of contract, breach of fiduciary duty, fraud, trade secret misappropriation, and professional negligence relating to services provided to a global cryptocurrency exchange platform.°
- Represented commercial construction company in a lawsuit alleging breach of fiduciary duty and trade secret misappropriation arising from the sale of LLC membership interests.°
- Represented a “Business Process as a Service” (BPaaS) technology company in a lawsuit filed by a payroll and HR services provider alleging breach of contract arising out of a copyright and ownership dispute relating to proprietary software program.°
