Brian Porter focuses his practice on real estate, construction, environmental & toxic tort, business, and other litigation. Brian represents developers, homebuilders, general contractors, subcontractors, and manufacturers in matters involving construction defects, construction liens, bond claims, and contract disputes. He has defended clients against multimillion-dollar claims involving breach of contract, indemnity, breach of express and implied warranties, building code violations, payment disputes, deceptive and unfair trade practices, and various negligence claims. Brian has defended and prosecuted construction defect claims in state court, federal court, and in arbitration. He also represents a variety of public and private clients in other complex litigation.
Prior to joining the firm, Brian served as a law clerk to the Honorable Mary S. Scriven of the U.S. District Court for the Middle District of Florida. While clerking with the federal district, Brian managed an assigned docket, drafted proposed orders in civil and criminal cases, advised the judge on legal issues, and assisted the judge in preparation for and at trials and hearings. Brian attended law school at the University of Florida Levin College of Law, where he graduated magna cum laude and earned membership in the prestigious Order of Coif.

- Representing an international aerospace company in mass-tort litigation involving allegations that emissions from a manufacturing facility caused plaintiffs to develop various cancers, central nervous system disorders, and congenital anomalies. Thus far, GT has secured dismissal with prejudice of a putative class action seeking medical monitoring and damages for alleged diminution in regional property values. GT has also won summary judgment on dozens of individual claims, including wrongful death claims, based on successful motions to exclude expert causation opinions as unreliable.
- Represented the plaintiff, a flooring manufacturer, in a breach-of-contract lawsuit filed against an exclusive distributor. Within a year of filing, GT won summary judgment in the full amount due, along with awards of prejudgment interest and attorneys’ fees.
- Represented the plaintiff, a commercial lawncare company, in a breach of contract, trade secrets, and business tort lawsuit against a private equity firm and competing lawncare company. The plaintiff alleged that the defendants misappropriated trade secrets acquired in due diligence for a potential acquisition then misused that information to unfairly compete for the plaintiff’s most significant clients. The matter resolved on confidential terms.Member of the trial team that represented the plaintiff, a prominent real estate developer, in a malicious prosecution and abuse-of-process lawsuit filed against a competitor who had attempted to have our client’s $130 million condominium building demolished in prior lawsuits. After years of litigation, including a successful interlocutory appeal vindicating our client’s rights to demand punitive damages and a multi-week jury trial, GT won verdicts of $1.8 million in compensatory damages (the full amount sought) and approximately $6 million in total punitive damages, including $1 million against the competitor’s CEO personally. GT also secured prejudgment interest and attorneys’ fee awards.

- Member of the legal team in representation of European automobile manufacturer in dispute with a U.S. based service provider claiming approximately $20 million in damages.
- Representation of a developer in a construction defect action for a multimillion-dollar high-rise residential condominium project.
- Representation of a developer in a property easement and signage dispute.
- Representation of a developer in a breach of contract matter for the construction of a luxury, high-rise condominium project.
- Represented national homebuilder/general contractor in putative class action in federal court.°
- Represented national homebuilder/general contractor in large volume of alleged construction defect cases resulting in settlement and resolution of a large number of cases.°
- Represented subcontractor in contractual and construction lien dispute resulting in summary judgment and award of attorneys’ fees for the client.°
- Represented client in alleged age-discrimination case resulting in summary judgment for the client.°
