Profile
Brian Porter focuses his practice on real estate, construction, environmental & toxic tort, business, and other litigation. Brian represents developers, homebuilders, general contractors, subcontractors, and manufacturers in matters involving construction defects, construction liens, bond claims, and contract disputes. He has defended clients against multimillion-dollar claims involving breach of contract, indemnity, breach of express and implied warranties, building code violations, payment disputes, deceptive and unfair trade practices, and various negligence claims. Brian has defended and prosecuted construction defect claims in state court, federal court, and in arbitration. He also represents a variety of public and private clients in other complex litigation.
Prior to joining the firm, Brian served as a law clerk to the Honorable Mary S. Scriven of the U.S. District Court for the Middle District of Florida. While clerking with the federal district, Brian managed an assigned docket, drafted proposed orders in civil and criminal cases, advised the judge on legal issues, and assisted the judge in preparation for and at trials and hearings. Brian attended law school at the University of Florida Levin College of Law, where he graduated magna cum laude and earned membership in the prestigious Order of Coif.

- Member of the legal team in representation of an international aerospace company in high-profile mass toxic-tort actions in which plaintiffs allege that emissions from a manufacturing facility caused property damages, injuries, and deaths. Plaintiffs seek injunctive relief, medical monitoring, and monetary damages.
- Member of the legal team in representation of an international exporter in an action seeking damages of more than $75 million.
- Member of the legal team in representation of European automobile manufacturer in dispute with a U.S. based service provider claiming approximately $20 million in damages.
- Representation of a developer in a construction defect action for a multimillion-dollar high-rise residential condominium project.
- Representation of a developer in a property easement and signage dispute.
- Representation of a developer in a breach of contract matter for the construction of a luxury, high-rise condominium project.
- Represented national homebuilder/general contractor in putative class action in federal court.°
- Represented national homebuilder/general contractor in large volume of alleged construction defect cases resulting in settlement and resolution of a large number of cases.°
- Represented subcontractor in contractual and construction lien dispute resulting in summary judgment and award of attorneys’ fees for the client.°
- Represented client in alleged age-discrimination case resulting in summary judgment for the client.°
