GT Shareholder David Sellinger will moderate and speak at the NJSBA's Annual Meeting and Convention on the panel "Recent Developments in Class Actions," which will cover the following topics:
- Recent Developments in the law governing arbitration agreements, class action waivers in arbitration agreements and stand-alone class action waivers as well as the rise of mass arbitrations, including: (i) the New Jersey Supreme Court’s decision in Pace v. Hamilton Cove; (ii) the Appellate Division’s decision in McGinty v. Zheng; (iii) the status of the mass arbitration rules enacted by the American Arbitration Association and JAMS; and (iv) an update on what's happening in mass arbitrations;
- Recent developments in data breach and privacy class actions;
- Problems encountered with the rise of claims fraud in the administration of class settlements, and issues relating to digital payment of class benefits;
- The ramifications, if any, of Robey v. SPARC Group, LLC, on the ascertainable loss requirement for Consumer Fraud Act claims; and,
- May a federal court certify a class when some members purportedly lack Article III injury.
