New Jersey State Bar Association's 2025 Annual Meeting and Convention

GT Shareholder David Sellinger will moderate and speak at the NJSBA's Annual Meeting and Convention on the panel "Recent Developments in Class Actions," which will cover the following topics:

  • Recent Developments in the law governing arbitration agreements, class action waivers in arbitration agreements and stand-alone class action waivers as well as the rise of mass arbitrations, including: (i) the New Jersey Supreme Court’s decision in Pace v. Hamilton Cove; (ii) the Appellate Division’s decision in McGinty v. Zheng; (iii) the status of the mass arbitration rules enacted by the American Arbitration Association and JAMS; and (iv) an update on what's happening in mass arbitrations;
  • Recent developments in data breach and privacy class actions;
  • Problems encountered with the rise of claims fraud in the administration of class settlements, and issues relating to digital payment of class benefits;
  • The ramifications, if any, of Robey v. SPARC Group, LLC, on the ascertainable loss requirement for Consumer Fraud Act claims; and,
  • May a federal court certify a class when some members purportedly lack Article III injury.
