James D’Cruz represents clients in corporate litigation matters. He has deep litigation experience gained through his time as a prosecutor for the state of Florida and as a reserve JAG for the United States Army. Building upon his experience within the JAG, James also advises government contractors on matters involving government procurements, including contract negotiation, bid protests, investigations, claims and disputes, and mergers and acquisitions. He works with government contracts clients within various industries, including but not limited to: defense, aviation, the space industry, and technology.

  • Confidential Client - On behalf of a government contractor we filed a sustained bid protest challenging the U.S. Air Force’s award of four contracts to supply aircraft interface test equipment. The protest was sustained based upon Agency’s failure to document a proper price realism or reasonableness evaluation and associated flawed price-related discussions, which resulted in a new source selection decision. As a result, the Agency was ordered to pay all costs of the protest.
  • 3M Company — Trial counsel and second chair in two bellwether trials in the largest multidistrict litigation (MDL) ever filed, where over 230,000 plaintiffs assert personal injury claims.°
  • Howard Energy Partners — Trial counsel for co-founder and various directors in expedited litigation in Delaware Court of Chancery over control of company.°
  • Bouchard Transportation Co., Inc. — Litigation counsel for Bouchard Transportation Co., Inc. and certain of its subsidiaries (BTC) in their Chapter 11 cases and related adversary proceedings before the United States Bankruptcy Court for the Southern District of Texas. Prior to the bankruptcy filing, BTC was one of the nation’s largest independently owned ocean-going petroleum barge companies operating within the Jones Act market, possessing a fleet of 24 barges and 25 tugs that provided oil and petroleum product transportation services. Assisted BTC in consummating two simultaneous value-maximizing sale transactions for substantially all of their assets that allowed their state of the art fleet to continue operating in the Jones Act market. Representing BTC in certain post-restructuring claims objections and related disputes.°
  • Gulfport Energy Corporation — Counsel for Gulfport Energy Corporation and its wholly-owned subsidiaries in their prearranged Chapter 11 restructuring and related adversary proceedings in the U.S. Bankruptcy Court for the Southern District of Texas.°
  • Winter Storm Uri Litigation — Litigation counsel for multiple Power Generators and Midstream Companies in Texas multidistrict litigation involving claims arising from Winter Storm Uri.°
