Fred Miles is known across the United States for his deep knowledge of health law, including the representation of providers in the post-acute services health care sector. Fred maintains an active regulatory trial practice, counseling clients on Medicare and Medicaid program issues such as fraud and abuse, licensing, certification, and reimbursement.

Fred’s deep administrative trial experience includes the representation of clients at the federal level in cases arising from licensing and reimbursement issues. He also regularly appears in state administrative forums across the Rocky Mountain Region. Fred has litigated numerous cases in state and federal courts, including appellate representation before the U.S. Court of Appeals for the Tenth Circuit, the Colorado Supreme Court, and the Colorado Court of Appeals.

Fred’s practice extends to government relations, where he advises clients on legislative initiatives and other matters before Congress and state legislatures. He also guides clients through alternative dispute resolution, including the mediation and arbitration of disputes in the health care field.

Experience

  • Appeared in the Colorado Supreme Court to present oral argument on behalf of the Colorado Association of Nurse Anesthetists (CoANA), the Colorado Nurses Association (CNA), and the Colorado Hospital Association (CHA) in litigation regarding decision of the Colorado Governor to opt-out of federal requirements for physician supervision of nurse anesthetists for the provision of anesthesia care in the state’s rural and critical care hospitals. He has represented these parties in this litigation since 2010.°
  • Served as lead counsel on behalf of a nursing facility in Colorado to maintain its certification in the state’s Medicaid program, obtaining a state injunctive order prohibiting its decertification. He additionally negotiated a Medicaid reasonable assurance process agreement, believed to be the first type of agreement ever consummated at the state level, to continue the facility’s participation in the state Medicaid program.°
  • Represented a nonproprietary managed care organization in state procurement litigation that turned aside an effort to cancel this award by an unsuccessful bidder. This resulted in sustaining the award of a contract worth $48M to that organization for it to become one of the state’s single-entry point agencies for Medicaid long-term care clients.°
  • Appointed as a Special Assistant Attorney General, representing the State Departments of Human Services and Health Care Policy and Financing in litigation concerning the state’s newly computer-automated Colorado Benefits Management System. This litigation kept the new system online and its management activities under the control of these state agencies.°
  • Appointed as founding Chair of the American Health Care Association’s Legal Committee, of which he is an active member. This group monitors legal matters affecting long-term facilities and their professionals, recommending specific legal involvement in cases and regulatory matters to the Association’s Executive Committee and its Board of Governors.°
  • Since 1980, acted as General Counsel to the Colorado Health Care Association (CHCA) where he authored the state Medicaid reimbursement statute for nursing homes. Conducts rate and other program related certification issues and negotiations with the state Medicaid agency.
  • Provided legal counsel to other association clients including the CNA, CoANA, and the American Association of Nurse Assessment Coordination (AANAC).°
