Darren Abernethy

Darren J. Abernethy is a data privacy attorney with more than a decade of experience, including in AmLaw private practice in Washington, D.C. and as in-house counsel at startups and a leading privacy technology vendor. He advises clients on matters related to advertising technology, privacy, data breach management, and FTC best practices.

Darren's concentrations include the California Consumer Privacy Act (CCPA), the European Union General Data Protection Regulation (GDPR)/ePrivacy, digital advertising, direct marketing, and IP-related transactional matters.

  • Counsel national restaurant, beverage, and retail chains on CCPA compliance implementations, privacy-related contracts, and privacy, cookie and employee policies.
  • Manage security incident management and response for health-device manufacturer.
  • Negotiate database licensing and related data sourcing agreements for AI consulting firm.
  • Served as legal lead for all EMEA data protection and California Consumer Privacy Act matters for multinational SaaS-based privacy technology solutions and certifications company.°
  • Provided product counseling guidance and strategic advice to spin up technology startups, including those deploying enterprise mobile messaging, e-commerce apps, and “smart” kitchen devices.°
  • Represented clients to regulatory and legislative bodies, including in matters before the FTC, FCC, DOJ, administrative law judges, and state public utility commissions.°
