Jonathan A. Schaub is a skilled litigator and trial attorney with broad experience defending employers against claims asserted in state and federal courts and arbitration. Jonathan regularly defends wage and hour class actions, PAGA and representative actions, and single-plaintiff actions concerning allegations of wrongful termination, discrimination, harassment, and retaliation, as well as matters involving trade secret misappropriation and whistleblower retaliation.

Jonathan also routinely handles high-value business disputes, complex commercial litigation, and consumer class actions, including claims relating to unfair competition, breaches of contract and fiduciary duties, privacy, intellectual property, and corporate governance.



  • Defended and resolved individual, class, and PAGA representative wage and hour actions on behalf of employers in diverse industries including hospitality, manufacturing, health care, staffing, and insurance.°
  • Represented publicly-traded electronic vehicle manufacturer in wrongful termination action brought by former engineer alleging discrimination, harassment, and whistleblower retaliation, leveraging dispositive motion into settlement.°
  • Achieved early resolution in defense of action brought by multinational golf equipment manufacturer against its outside IT company arising from an alleged breach of manufacturer’s computer system by IT company’s former employee.°
  • Represented construction materials manufacturer and its manager against claims of disability, national origin, age, and gender discrimination asserted by two employees, achieving settlement at summary judgment stage.°
  • Obtained early disposition of suit brought against former executive employee concerning alleged negligent hiring and supervision via a sustained demurrer at the pleading stage without leave to amend.°
  • Defended custom vehicle design company in wrongful termination, gender discrimination, and whistleblower retaliation action brought by company’s former human resources director.°
  • Represented insurance brokerage and principal in a sexual harassment, discrimination, and whistleblower retaliation action filed by former employee.°
  • Obtained voluntary dismissal of trade secret misappropriation suit filed by private equity firm against former executive employee.°
  • Defended action brought by nationwide restaurant chain alleging that the former employee of a forensic investigation company conducted a faulty investigation into an apparent data breach and destroyed data.°
  • Represented executive search agencies in related actions concerning misappropriation of trade secrets and breach of non-compete agreements.°
  • Represented and counseled executive in connection with SEC investigation into a possible fraudulent investment scheme at company.°
  • Obtained complete defense judgment as second chair at trial in suit brought by shareholder against business entity and individual director alleging conflicts of interest and breach of fiduciary duty.°
  • Served as second chair at trial in suit brought by multiple shareholders against business entity concerning allegations of breach of fiduciary and Open Meeting Act-styled claims, resulting in complete defense judgment.°
  • Represented privately held multifamily real estate development and management firm in dozens of related actions concerning alleged ICRAA violations asserted by 300+ plaintiffs.°
  • Defended nationwide multifamily utility management company against putative consumer class action concerning allegations of fraudulent billing practices.°
  • Represented terminated distributors in complex antitrust, tortious interference, and unfair competition suit against major consumer electronics product manufacturer and its retained distributors.°
  • Achieved resolution on behalf of restauranteur in action against former business partners for fraud, breach of fiduciary duty, defamation, and dissolution, after successful opposition of Anti-SLAPP motion.°
  • Obtained early disposition of lawsuit filed against capital management company via a successful Anti-SLAPP motion, leading to an award of client’s attorneys’ fees and costs.°
  • Represented group of investors asserting individual and derivative claims for investment fraud in connection with a shale oil industry saltwater disposal business, achieving resolution.°
  • Defended water feature design company against cross-claims of professional negligence arising from property owner’s lawsuit against architecture firm relating to multimillion-dollar single-family residential construction project.°
  • Defended publicly traded international hospitality group in federal court in dispute with landlord arising from development of two new restaurant locations, leading to settlement after successfully opposing summary judgment.°
  • Represented investor in 10b-5 securities fraud case against publicly-traded corporation based upon misrepresentations in public filings and accounting fraud.°
  • Secured dismissal with prejudice of action filed against investment firm by a group of limited partners of an acquired business at the pleading stage of action.°
  • Served on trial team defending a startup company against a multinational gaming conglomerate’s allegations of intellectual property misappropriation and breach of contract, resulting in complete defense verdict.°
  • Co-chaired a six-day trial regarding a musical artist’s unauthorized use of the client’s name and likeness in a music video, resulting in a judgment in favor of the client, including awards of punitive damages and attorneys’ fees.°
  • Represented investors in suit against inventor of novel tool product alleging misappropriation of intellectual property and company funds.°
  • Defended international apparel store chain client against claims of copyright and publicity rights infringement brought by group of photographers and musical artists.°
