Evelyn Cobos represents clients in a wide range of complex commercial, products liability, consumer, real estate, insurance, business, and other civil matters before state and federal courts and various arbitral forums throughout the United States. Evelyn has litigated matters involving contract disputes, consumer claims, fraud, fiduciary relationships, business torts, real estate issues, trade secrets, intellectual property, personal injury, employee non-competition agreements, false advertising, and hospitality disputes. With her clients’ needs in mind, Evelyn uses creative litigation strategies that allow her to work toward the legal goals of her clients.

Experience

  • Obtained summary judgment in favor of client, a global software company, in a false advertising Lanham Act case seeking tens of billions in damages, injunctive relief, and disgorgement of profits.
  • Represented a South American distributor of machinery against a global construction equipment manufacturer in two cross-border cases involving breach of contract claims for $130 million and obtained dismissal of both actions on behalf of client on forum non-conveniens grounds given a related parallel litigation in Curacao and for plaintiff’s failure to state a claim.
  • Represented a global technology company in a personal injury case brought by the parents of a minor child who alleged the child suffered a traumatic brain injury after falling in one of the company’s stores while playing a virtual reality game.
  • Represented a national car rental company in a personal injury lawsuit brought by a cyclist who claimed to have suffered a traumatic brain injury following an accident involving the company’s car that was driven by an employee.
  • Represented a hotel owner in a contract dispute with an international hotel management company over obligations under the management agreement during Covid and related force majeure issues.
  • Represented an Indian orthopedic implant manufacturer in a contract dispute with a Puerto Rican distributor.
  • Obtained summary judgment for a real estate buyer in a specific performance case following a sales contract dispute whereby the court granted the rare and equitable relief of ordering the seller to turn over the property to the buyer.
  • Represented a global software company in a consumer claim arbitration where the consumer claimed automatic software updates were not agreed to and caused damage to her computer.
  • Resolved hundreds of first-party property and third-party liability claims in favor of clients.
