Jeffrey Greene serves as Co-Chair of the Boston Litigation Department and Co-Chair of the firm’s global eDiscovery & eRetention Practice. Jeff is an experienced trial lawyer who focuses his practice on litigation and investigations that involve complex legal, factual and data management issues. Jeff represents a variety of clients in the automotive, retail, manufacturing, technology, medical device and pharmaceutical industries who are facing complex litigation and/or government investigations.  He handles all phases of litigation and has tried cases in both federal and state courts, as well as in proceedings before administrative bodies and in domestic and international arbitrations.

Jeff has served as eDiscovery and information governance counsel for more than a dozen Fortune 500 companies, responsible for coordinating the overall strategy for records retention as well as for preservation, collection, review and production of ESI in thousands of state and federal lawsuits as well as government investigations.

In addition to his litigation practice, Jeff represents companies on a broad range of data privacy and security governance issues, including managing trans-national data flows, navigating conflicts between foreign privacy laws and US compliance obligations, regulation of advertising and marketing practices, privacy regulation of employee data, due diligence in sales of corporate assets, records management and responses to government surveillance requests.  Jeff also assists clients in bringing to market compliant applications and products that collect personal, financial, and other sensitive information. Jeff’s broad litigation background allows him to advise clients on the litigation risks they face in determining how to handle data privacy issues.

Jeff also has substantial experience guiding companies through all facets of cybersecurity, including developing policies and procedures before an incident arises, addressing the important actions immediately following breach situations.  Having served as lead counsel responding to hundreds of data breach, ransomware and other data privacy situations, Jeff leads his clients through security incidents, including investigations, containment, remediation, communications, and contractual and legal obligations.  He regularly counsels clients on board and leadership preparedness, cybersecurity preparedness reviews, incident response, federal government engagement and regulatory compliance.

  • Acted as national eDiscovery coordinating counsel for international company in connection with hundreds of state and federal class action cases.
  • Acted as lead eDiscovery and technology counsel on financial institution merger, responsible for developing efficient, defensible process for mapping and preserving hundreds of ESI data sources.
  • Developed comprehensive data mapping, records retention and eDiscovery governance policies for major telecommunications company.
  • Represented global pharmaceutical company in developing eDiscovery governance policies and procedures in domestic and European operations.
  • Advised national specialty retailer on retention, preservation and collection issues for structured and unstructured ESI in response to multiple government investigations.
  • Represented international retailer in defense of state and federal wage and hour class actions.
  • Represented pharmaceutical and medical device companies in mass tort litigation.
  • Assisted clients in insurance coverage matters which have resulted in more than $100 million in client recoveries.
