Aaron Van Nostrand focuses his practice on general and complex litigation on behalf of clients of all sizes. He has wide-ranging experience in commercial litigation and class action defense, as well as breach of contract, fraud and breach of fiduciary duty, product liability, consumer finance, pharmaceutical licensing, real estate and oppressed shareholder litigation. Aaron also litigates and counsels clients in franchise disputes. He represents franchisors in litigation against franchisees involving claims of breach of contract, fraud and consumer fraud, tortious interference, and violation of various state franchise laws. He also regularly represents franchisors in litigation and disputes against third parties in a variety of contexts, such as real estate, construction, and consumer fraud. In addition, he helps clients pursue alternatives to litigation. In recent years, he has served as counsel in individual and class cases in California, Connecticut, Florida, Georgia, Maryland, Massachusetts, New Jersey, Ohio and Texas.

  • Obtained $4.2 million verdict on behalf of a member of a surgery center in Northern New Jersey on claims of breach of fiduciary duty and breach of the implied covenant of good faith and fair dealing as a result of being involuntarily terminated as a member of the surgery center at an unfair price.
  • Member of GT team that secured dismissal of MDL national class action against Toshiba America Consumer Products involving alleged misrepresentations in marketing of HD-DVD players in connection with format war between HD-DVD and Blue-Ray.
  • Member of GT team that secured dismissal of two potential $1.5 billion national class actions against Toshiba America Information Systems on behalf of hundreds of thousands of purchasers of over 60 models of notebook computers alleged to have defect in plastic covers and hinges.
  • Counsel for HSBC in multiple actions for violation of the Truth in Lending Act and obtaining dismissal of claims on various bases.
  • Obtained dismissal of product liability claims against Medtronic, Inc. on preemption grounds.
  • Counsel for Verizon Wireless in defense of a putative FDCPA class action in which Verizon Wireless successfully enforced arbitration clause.
  • Prevailed in arbitration on behalf of international pharmaceutical company in proceeding before the International Center for Dispute Resolution regarding the rights and obligations under a licensing contract and defeated claims for material breach and termination of contract.
  • Counsel for international pharmaceutical company in an arbitration proceeding before the International Chamber of Commerce asserting claims for breach of a licensing agreement and misuse of trade secrets, which settled on very favorable terms.
  • Obtained reversal before the New Jersey Appellate Division of $2.5 million judgment against client on a claim for indemnification for the costs of a product recall.
  • Represent franchisor in putative class action asserting claims for fraud, declaratory relief, and violation of various franchise disclosure laws.
  • Represent franchisors in connection with leases and other commercial disputes with landlords.
  • Represent franchisor in matter involving claims for damages for failure to perform franchise agreement and defense of claims for breach of contract, fraud, and violation of various franchise laws and involving substantial issues relating to jurisdiction, arbitration, and venue.
  • Represent franchisor in dispute with contractor retained to build out a location.
  • Represent franchisors in disputes with former franchisees for breaches of franchise agreements and to collect amounts due thereunder.
