Jennifer M. Faggion, a member of Greenberg Traurig's Litigation Practice, is based in the firm’s Tampa office. Jennifer’s practice includes complex commercial litigation, real estate, toxic tort, environmental, and white collar matters in both federal and state courts.
Prior to joining the firm, Jennifer served fifteen years as a federal judicial law clerk for several judges in the U.S. District Court for the Middle District of Florida. In that role, Jennifer drafted proposed orders on procedural and substantive issues, including opinions on dispositive motions, motions for preliminary injunction, motions for class certification, motions to compel arbitration, and discovery motions, in a district with one of the heaviest caseloads in the country and a personal caseload of more than 200 civil cases. She attended and assisted the Judges with both civil and criminal hearings, trials, and other proceedings, and collaborated with the Judges on recommended disposition of motions and other requests for relief. Notably, Jennifer received a “Top Secret” security clearance to assist with cases involving national security implications. She therefore possesses substantial skills in legal research, writing, and case management in complex federal litigation and brings to our practice and clients a thorough understanding of the federal court system, including the broad range of factual, legal, and procedural issues involved.

Experience
- Representing an international aerospace company in mass-tort litigation involving allegations that emissions from a manufacturing facility caused plaintiffs to develop various cancers, central nervous system disorders, and congenital anomalies. Thus far, GT has secured dismissal with prejudice of a putative class action seeking medical monitoring and damages for alleged diminution in regional property values. GT has also won summary judgment on dozens of individual claims, including those for wrongful death, based on successful motions to exclude expert causation opinions as unreliable.
- Representation of a major national and international real estate developer in multiple matters involving complex contract and real estate issues.
- Member of the trial team that represented the plaintiff, a prominent real estate developer, in a malicious-prosecution and abuse-of-process lawsuit filed against a competitor who had attempted to have our client’s $130 million condominium building demolished in prior lawsuits. After years of litigation, including a successful interlocutory appeal vindicating our client’s rights to demand punitive damages and a multi-week jury trial, GT won verdicts of $1.8 million in compensatory damages (the full amount sought) and approximately $6 million in total punitive damages, including $1 million against the competitor’s CEO personally. GT also secured prejudgment interest and attorneys’ fee awards.
- Representation of a group of real estate developers and a real estate investment firm as amici counsel in a high-profile appeal involving the interpretation of Florida condominium laws. The case addresses critical issues surrounding amendment procedures for condominium declarations and voting thresholds for termination, with significant implications for redevelopment efforts and the safety of residents in aging buildings throughout the State of Florida.
- Advised national and international real estate developer on the rights, restrictions, and impacts of an easement on a multi-million-dollar development and assisted in resolving potential resulting litigation.
- Resolved commercial real estate dispute for a national pharmaceutical company.
- Representing a social networking platform against claims of wrongful death, strict liability and negligence arising from alleged product design and defect, strict liability for defective design, negligence, intentional and negligent infliction of emotional distress, negligent misrepresentation, civil liability under 18 U.S.C. § 1595, violation of Florida’s Deceptive and Unfair Trade Practices Act, and negligent design of a geo-social networking application.
