Michael R. Hogue focuses his practice on construction law, business and financial services litigation, and bankruptcy restructuring and reorganization. Michael also advises clients regarding various copyright, trademark and trade secret matters.

In his construction practice, Michael represents both owners and contractors through the various stages in developing commercial and residential projects throughout the country from initial design stages through the completion of construction. He has represented large commercial owners and developers in contract and construction defect litigation in both state and federal court.

Michael’s business and financial services practice includes representations in state and federal court. He represents lenders and loan servicers on breach of contract, FDCPA, RESPA, TILA, deficiency actions and title disputes. Michael also represents plaintiffs and defendants in several areas of litigation, including breach of contract, fraud, unjust enrichment, defamation, copyright and trademark infringement, and misappropriation of trade secrets. He assists clients in pre-litigation counseling, electronic discovery, as well as trying cases before judges and juries in both state and federal court.

Additionally, Michael represents creditors, particularly lenders and loan servicers, in bankruptcy proceedings under Chapters 7, 11, and 13, focusing on bankruptcy litigation throughout Nevada, Arizona, California, and Washington. He also advises debtors with regard to various restructuring efforts ranging from pre-bankruptcy workouts to Chapter 11 petitions and plans.

  • Represented loan servicers in adversary proceedings regarding fraudulent transfers, contested lien priority and validity, and post-discharge foreclosures.
  • Represented secured and unsecured creditors in various Chapter 11 restructurings and Chapter 7 liquidations in multiple jurisdictions.
  • Represented corporate and individual borrower and guarantor defendants related to a $500 million syndicated credit facility on a 1,700-acre master planned development.°
  • Represented numerous debtor entities in Chapter 11 restructuring of multibeneficiary loans regarding commercial real estate valued at over $300 million.°

  • Represented lenders and loan servicers in several putative class actions involving FCRA, TILA, RESPA, and state statutory claims.

  • Represented lenders in deficiency actions against borrowers and guarantors, consistently obtaining judgments and favorable settlements.

  • Represented majority investor/shareholder in suit against company and officers using company to facilitate Ponzi scheme.
  • Represented majority shareholders and directors in corporate dispute involving reverse merger of a publicly traded corporation.°

  • Represented owner in contract negotiations for development of $100 million condominium development in Northern Nevada.
  • Represented contractor in negotiations for $10 million hotel project in Arizona.
  • Assisted contractors in developing contracts for subcontractors and vendors in numerous jurisdictions, including California, Nevada, Arizona, Texas, and Florida.
  • Represented international gaming and hotel company in contract and construction defect dispute regarding $6 billion commercial development.
