Zachary Kimmel is a member of the Labor & Employment Practice in Greenberg Traurig's Philadelphia office. His practice focuses on representing employers in workplace law matters, including collective bargaining negotiations; advising on recruiting, hiring, evaluating, and terminating employees; internal investigations; and counseling public, private, and nonprofit entities on a range of labor law matters. Those include issues concerning the Fair Labor Standards Act wage and hour, Americans with Disabilities Act, Title VII and analogous state anti-discrimination laws, as well as to the Family Medical Leave Act; New Jersey’s Conscientious Employee Protection Act (NJCEPA) and the Uniformed Services Employment and Reemployment Rights Act, among others. He counsels and defends employers on day-to-day issues, including employee discipline and employees’ leaves of absence.

- Obtained determination from Delaware Department of Labor concerning former employee’s alleged entitlement to vacation time payout.°
- Secured dismissal of discrimination claims under NJLAD related to arbitration agreement.°
- Assisted in negotiations culminating in first collective bargaining agreement between global company and newly recognized union.°
- Defended numerous unfair labor practice charges premised on allegations of bad faith bargaining and unilateral changes to work responsibilities.°
- Counseled non-profit entity regarding applicability of Federal CMS Mandate and New Jersey Executive Orders requiring COVID-19 vaccination.°
- Drafted policies for company with national presence in connection with OSHA’s vaccination mandate.°
- Investigated allegations concerning decade long practice of racial discrimination by department supervisors at University. °
