Emerson B. Luke focuses his practice on commercial, trusts and estates, and entertainment litigation. His commercial litigation practice includes litigating breach of contract, intellectual property, trade secrets, and real estate disputes. Emerson has deep trusts and estates litigation experience, having represented clients in trust and will contests, conservatorship matters, breach of fiduciary duty cases, and accounting disputes. Emerson also has experience defending clients in labor and employment matters including wage and hour class actions, as well as in matters relating to harassment and discrimination.

Emerson’s entertainment litigation experience includes the representation of studios, managers, and producers in connection with claims arising from motion picture distribution rights, breach of contract, content licensing, residual allocation claims, and participation accounting issues. He represents clients in state court as well as before the Independent Film & Television Alliance (IFTA) arbitration tribunal.

  • Member of trial team that represented plaintiff (a business manager) against the estate of a deceased musician for breach of management contract. Helped secure settlement on behalf of client against the estate.°
  • Mediated disputes on behalf of major financial institution.°
  • Engaged in transactional work for a technology client, including drafting common stock purchase agreements, advising executives of exposure to liability for new application features, and assisting in the negotiations between corporate counsel for terms under which the client partners with new investors.°
