Daniell Newman helps top consumer brand clients develop litigation strategies that meet both their case-specific and larger business objectives. A trial-experienced litigator, Daniell has represented household brands such as Ford, KPMG, Live Nation, Lotus Cars, Mars, Nissan, Ocean Spray Cranberries, PepsiCo, Starbucks, Tropicana, Welch’s, and Whole Foods in commercial litigation matters. As a member of the American Lawyer’s 2018 Products Liability Group of the Year, Daniell has a wealth of experience in products liability and toxic tort defense. He is part of the national and trial counsel team the world’s largest manufacturer of medical devices and he represents multinational pharmaceutical companies in litigation throughout the country. Daniell represents some of America’s best-known food and beverage companies, defending claims of false advertising under the federal Lanham Act and state consumer protection statutes. Daniell also represents major automotive manufacturers in ongoing litigation throughout the country and is part of a team serving as lead trial counsel for an American multinational automaker in various federal and state court actions in California.

  • Represented auto makers in the defense of dozens of cases alleging false advertising and under various state consumer protection statutes.
  • Obtained unanimous jury verdict in favor of client Ocean Spray in federal Lanham Act trial concerning the labeling and advertising of Ocean Spray’s 100% Juice Cranberry & Pomegranate flavored juice blend. Recognized by The Daily Journal as a "Top Defense Verdict" of the year.
  • Obtained unanimous jury verdict in favor of client Tropicana in a similar federal Lanham Act trial concerning the labeling and advertising of Tropicana’s 100% Pomegranate Blueberry flavored juice blend.
  • Obtained unanimous jury verdict in favor of client Welch’s in federal Lanham Act trial concerning the labeling and advertising of Welch’s 100% Juice White Grape Pomegranate flavored juice blend.
  • Representation of global concert promotion company in dispute over sale of live theatre assets abroad.
  • Defense of former manufacturers of asbestos-containing products in dozens of cases alleging claims of personal injury and product liability, including a complete jury verdict for the defense.
  • In the last two years, secured the dismissal of his client in over a dozen cases alleging toxic exposure in over the counter consumer goods.
  • Defended a multinational pharmaceutical company in numerous cases throughout the United States involving alleged personal injury from the use of a consumer product.
  • Defended one of the world’ largest medical device companies in litigation related to a variety of medical devices.
  • Member of trial team representing a Fortune 500 natural gas and electric utility against consolidated multibillion-dollar antitrust class actions.
  • Defense of major financial advisory firm against claims of fraud and breach of fiduciary duty claims in the accounting context.
