Daniell K. Newman's practice is focused on helping clients develop litigation strategies that meet both their case-specific and larger business objectives. He has represented household names such as KPMG, Live Nation, Mars, MySpace, Nissan, Ocean Spray, Pepsi, Sempra Energy, Starbucks, Tropicana, Welch’s and Whole Foods.

Daniell has considerable jury trial experience, defending complex civil disputes in a variety of areas. He has represented some of America’s best-known food and beverage companies in federal court, defending claims of false advertising under the Lanham Act and state consumer protection statutes. He also has a wealth of experience in products liability and toxic tort defense in over a dozen cases in California state courts. His broad experience in defense of consumer class actions includes CAFA actions, and he has helped numerous clients achieve successful settlements/resolutions of these cases.

  • Obtained unanimous jury verdict in favor of client Ocean Spray in federal Lanham Act trial concerning the labeling and advertising of Ocean Spray’s 100% Juice Cranberry & Pomegranate flavored juice blend. Recognized by The Daily Journal as a "Top Defense Verdict of 2011." 
  • Obtained unanimous jury verdict in favor of client Tropicana in a similar federal Lanham Act trial concerning the labeling and advertising of Tropicana’s 100% Pomegranate Blueberry flavored juice blend.
  • Obtained unanimous jury verdict in favor of client Welch’s in federal Lanham Act trial concerning the labeling and advertising of Welch’s 100% Juice White Grape Pomegranate flavored juice blend.
  • Defense of major pet food manufacturer in proceedings alleging false advertising brought by competing pet food company before the National Advertising Division of the Better Business Bureau.
  • Defense of Internet marketing company in lawsuits alleging false advertising and violations of consumer protection laws.
  • Representation of global concert promotion company in dispute over sale of live theatre assets abroad.
  • Defense of former manufacturers of asbestos-containing products in over a dozen cases alleging claims of personal injury and product liability. The one trial that proceeded through verdict resulted in a complete jury verdict for the defense in 2012.
  • Member of trial team representing a Fortune 500 natural gas and electric utility against consolidated $multi-billion antitrust class actions.
  • Defense of major financial advisory firm against claims of fraud and breach of fiduciary duty claims in the accounting context.
