Alayne Opie is a shareholder in the firm’s commercial litigation group, with deep experience representing businesses and their executives in a wide range of matters. She has represented clients before administrative bodies, regulatory boards, in arbitration, and in state, federal, and multidistrict courts. Alayne’s experience traverses state lines, having previously practiced in Nevada, California, Florida, New Jersey, New York, Delaware and elsewhere, servicing the needs of clients based in those states, as well as internationally in England, Nigeria, and BVI. Her diverse client base includes publicly traded companies, local mom-and-pop shops, and virtually everything in between, covering a wide array of industries, including but not limited to casinos, gaming, gas and oil, agriculture, telecommunications, automotive, real estate, storage, professional services, and entertainment. While Alayne works on general disputes affecting businesses and individuals, she is best versed in class actions, derivative lawsuits, member/manager fiduciary claims, TCPA claims, trust and estate litigation, securities suits, commercial landlord/tenant issues, and breach of contract matters. Alayne has been consistently recognized in Best Lawyers, Super Lawyers, and local Nevada publications as a Top Rank Attorney.

Experience

  • Obtained judgment in favor of client while upholding contractual choice of laws and venue provisions in highly contested gaming dispute.
  • Defended well known adult entertainment venue in class action litigation where independent contractors sought to retract prior contractual agreement and pursue employment wages and benefits.
  • Represented large hotel and casino in Las Vegas in connection with allegations of violating Nevada’s condominium-hotel statues, NRS 116B.
  • Obtained early summary judgment in construction dispute litigation, potentially saving client tens of thousands of dollars.
  • Defended drug and alcohol rehabilitation facility against mass tort claims and prospect for multidistrict litigation, leading to settlement resolutions.°
  • Obtained multiple dismissals of lawsuits against mortgage lenders and servicers involving claims of fraud and alleged violations of Nevada’s Homeowners Bill of Rights.
  • Obtained dismissal of punitive damages claim with potential value in excess of $50 million.
  • Represented a gaming technology provider against claims of fraud where plaintiff sought exemplary damages.
  • Obtained full dismissal in gaming matter post 5-year patron gaming dispute.
