A new California law that took effect July 1 requires restaurant chains with 20 or more locations nationwide to disclose the nine major food allergens on menus at their California locations, creating new compliance challenges and potential litigation risks for restaurants that fail to accurately identify allergens.

Lagesen, chair of Greenberg Traurig’s global Restaurant Industry Group, noted that unlike packaged food manufacturers, restaurants operate in a fast-moving environment where ingredient substitutions, supplier changes, and kitchen-level decisions could create compliance risks. He cautioned that “mistakes will happen,” making litigation likely under California’s new law, but also observed that many restaurant operators view the requirements as an opportunity to better serve guests with food allergies, build customer trust, and differentiate themselves through transparency.
